1. About these terms
These Terms of Service ("Terms") form a binding agreement between you and FlyHandled Ltd. ("FlyHandled", "we", "us"), [Legal form, e.g. private limited company], registered at [Registered office address], [Company register and registration number]. They govern your use of the FlyHandled app and website (the "Service").
The following documents form part of these Terms and apply where relevant: the Privacy Policy, Cookie Notice, Disclaimer, Claims Terms, FlyHandled+ Terms, Fees Policy and Acceptable Use Policy. If they conflict, the more specific document prevails for its subject (for example, the Claims Terms for claim handling).
By creating an account, confirming these Terms in the app, or using the Service, you agree to them. If you do not agree, do not use the Service.
2. Who can use FlyHandled
- You must be at least 18 years old. Children can be included as passengers on a trip or claim by a parent or legal guardian.
- You must give accurate information and keep it up to date.
- If you act for other passengers (for example, family members on your booking), you confirm that you are authorised to do so.
- You may hold one personal account. Business use requires our written agreement.
3. What the Service provides
Free features include the flight check (no account needed), adding flights, basic status, the rights checker, entry and bag guides, claim eligibility and basic disruption help, and phone or email alerts where they are available. Optional paid plans, the Trip Pass (one trip) and FlyHandled+ (a membership), are described in the FlyHandled+ Terms. FlyHandled provides passenger-rights information and claim assistance. It is not a law firm and does not guarantee compensation.
Flight information comes from third parties and may be incomplete, delayed or wrong. Always follow the instructions of your airline, airport and the authorities. Do not rely on the Service for safety or time-critical travel decisions.
4. Not legal advice
FlyHandled provides general information about passenger rights. It is not a law firm in every jurisdiction and does not give personalised legal advice. No lawyer-client relationship arises from using the Service. Where legal action is needed, it is conducted by independent, licensed legal partners, as explained in the Claims Terms. Please read the Disclaimer.
4a. Claims we handle for you
FlyHandled Protect handles a claim for you only after you sign a claim authorisation (mandate) for it. The mandate lets us contact the airline in your name, submit and follow up the claim, negotiate, receive the payment for you and deduct the fee shown to you before you signed. The Claims Terms and the Claim Authorisation set out exactly what you agree to and how to withdraw.
Legal action is not something you can buy in the app. If a claim can only move forward in court, we tell you first and explain what it costs; independent, licensed counsel would act.
4b. Not insurance
FlyHandled Protect, the Trip Pass and FlyHandled+ are services, not insurance. They do not pay you anything themselves; any compensation comes from the airline, and only if your claim succeeds.
5. Your account
Keep your sign-in details secure and tell us promptly if you suspect unauthorised use. You are responsible for activity on your account unless it results from our failure to protect it.
6. Acceptable use
You must comply with the Acceptable Use Policy. In particular, never submit false, altered or duplicate claims or documents.
7. Fees and payment
Everything described as free is free. Fees for claim handling and prices for paid plans are set out in the Fees Policy and shown in the app before you commit. Prices include VAT where applicable. Payments are processed by third-party payment providers; we do not store full card details.
8. Intellectual property
The Service, including its design, software, text and the FlyHandled name and logo, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service for its intended purpose.
You keep ownership of the information and documents you upload. You grant us the rights we need to host, process and share them as described in the Privacy Policy and Claims Terms, only to provide the Service to you.
9. Third parties
The Service interacts with airlines, airports, enforcement bodies, courts, map providers and payment providers. We are not responsible for their decisions, content or availability. Airline and authority names are used for identification only and do not imply endorsement.
10. Changes to the Service and these Terms
We may improve or change the Service. We may update these Terms for legal, regulatory, security or product reasons. Each version is dated and numbered. We will tell you about material changes in advance, and where the law requires it we will ask you to accept the new version before you continue. Changes do not affect claims already submitted or plans already paid for, which remain under the terms in force at the time.
11. Suspension and termination
You may stop using the Service and delete your account at any time in Settings. We may suspend or close accounts that breach these Terms, the Acceptable Use Policy or the law, or that put others at risk. Where reasonable, we will warn you first. What happens to claims in progress is explained in the Claims Terms.
12. Our liability
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.
Subject to that, we are not liable for: decisions made by airlines, courts or authorities; the outcome of a claim; losses caused by inaccurate information you provided; or losses that were not reasonably foreseeable. Our total liability to you under these Terms is limited to the greater of the fees you paid us in the 12 months before the claim arose and €100.
13. Your consumer rights
If you are a consumer, you benefit from the mandatory protections of the law of the country where you live. Your right to withdraw from paid plans is explained in the FlyHandled+ Terms.
14. Complaints
Contact us at support@flyhandled.example. We acknowledge complaints within 5 working days and aim to resolve them within 14 days. If you remain unhappy, you may contact your local consumer protection authority or an alternative dispute resolution body where one is available. [Statement on participation in consumer dispute resolution, as required in the operator's jurisdiction].
15. Governing law and courts
These Terms are governed by [Governing law, e.g. the laws of Ireland]. Disputes are subject to [Competent courts, e.g. the courts of Dublin, Ireland]. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts of that country.
16. General
- If any part of these Terms is found invalid, the rest remains in effect.
- We may transfer our rights and obligations to a company that takes over the Service, provided your rights are not reduced. You may not transfer yours without our consent.
- A failure to enforce a right is not a waiver of it.
- These Terms are written in English, which is the binding version. Translations are provided for convenience.
