How a claim works

1. Keep your boarding pass, your booking and the receipts for anything you bought while waiting.

2. Write to the airline that operated the flight, through its claim form or by email. Ask for the compensation in article 7 of Regulation 261/2004 and the costs of care in article 9.

3. If it refuses or does not reply, ask for the reason in writing and complain for free to ANPC.

What counts as extraordinary circumstances

Weather that makes the flight unsafe, air traffic control restrictions, security risks and strikes outside the airline, such as by air traffic controllers. A technical fault with the aircraft is usually not extraordinary (Court of Justice of the EU, case C-549/07), and a strike by the airline's own staff never is (case C-28/20). The airline has to prove the cause and that it took all reasonable measures.

If the airline refuses or does not reply

A refusal is not the last word. Ask for the exact reason in writing. You can complain for free to ANPC, the body that enforces passenger rules in Romania, or to the body in the country of departure.

ANPC takes complaints through the online form on anpc.ro, in Romanian and English, or by email at secretariat@anpc.ro.
